Is Your Idea Patentable?

Patentability is dependent on multiple factors that are explained in the Manual of Patent Examining Procedure. All inventors need to ask the simple question: “Is my idea patentable?” This should be the first question, and it will save you time, money, and heartaches.

Research the Marketplace

After the patentability search is completed and you have determined that your invention is patentable subject matter the next step is determining whether or not you will receive a patent. Now it is time to look into the public domain and figure out if anyone has published, sold, or used your invention in the past. If someone has already invented the same exact invention, has invented it or is publicly selling, using, then you are not eligible receive a patent. In other words, it was already invented therefore you cannot patent it. It is your duty to disclose this information to Nuventus practitioners as it will save you time and money moving forward.

Document your Invention

Documenting your invention can be a difficult task. Our practitioners cannot read your mind. This was one of the reasons why we developed “The Nuventus Methodology.” At this stage in our process, we guide you through documenting your invention in a format that allows our practitioners to understand the unique aspects of the invention. We call this your pseudo specification. By streamlining this process, we save time which in turn saves you money. This provides our practitioners a format that decreases the amount of time to understand your invention. This step is important as it sets the stage for the later steps and further cost savings, which we pass onto you.

Nuventus Performs a Prior Art Search

We highly recommend that our clients have a prior art search performed on their invention. It is an additional cost but a necessary one. When you invest in a home or company, the first thing you do is research the different aspects of that investment to ensure that it will flourish and provide a return on investment. Prior art searches (PASs) can be viewed in the same manner. A PAS offers insight into the current patents and publications on similar inventions and supplies you and our practitioners with the leverage needed to work around the prior art and help you create a patentable invention.

The prior art search provides you and our practitioners with insight. At this stage, our practitioners use that insight to help you develop a strategy on how we can improve your invention to increase the likelihood of receiving an allowance. The question that is answered at this stage is what modifications do you have to make to your invention. Many inventors proceed with filing their IP without a PAS and run into trouble. By failing to perform a prior art search, the inventor cannot use the resulting information to modify their invention. At Nuventus, this stage in our methodology provides the most value to clients and has proven time and again to be the difference between receiving an allowance or rejection.

Nuventus Drafts and Files Your Invention At The USPTO After Your Review and Approval

Drafting a patent application requires an understanding of the Manual of Patent Examining Procedure, which governs the USPTO. More importantly one must be skilled at drafting claims. Our methodology leads the client through a series of steps that helps our practitioners to prepare a broad specification and associated claims quickly. Using your pseudo specification and figures, from step 4, a patent application and claim are drafted. Once you approve them, then they will be filed.
